En optant pour cette d\u00e9marche, les parties r\u00e9cup\u00e8rent la ma\u00eetrise de leur conflit et \u0153uvrent ensemble, avec l\u2019aide du m\u00e9diateur, \u00e0 l\u2019apaiser, voire \u00e0 trouver un accord. Je suis un tiers neutre, impartial et ind\u00e9pendant, l\u2019invit\u00e9e dans une conversation.<\/span><\/p><p class=\"p1\"><span class=\"s1\">\u2022 <strong>Pistes de solutions et n\u00e9gociations<\/strong><span class=\"Apple-converted-space\">\u00a0 <\/span>\u2014<span class=\"Apple-converted-space\">\u00a0 <\/span>Apr\u00e8s avoir dress\u00e9 la liste des questions importantes, les parties recherchent et \u00e9bauchent les meilleures solutions possibles et durables au diff\u00e9rend. <\/span><\/p><p class=\"p1\"><span class=\"s1\">\u2022 <strong>Accord<\/strong> \u2014 Si les parties trouvent un terrain d\u2019entente, m\u00eame partiel, celui-ci peut \u00eatre formalis\u00e9 dans un \u00e9crit (un accord de m\u00e9diation, selon la loi) qu\u2019elles s\u2019engagent \u00e0 respecter. La loi pr\u00e9voit qu\u2019il est possible d\u2019obtenir une homologation de cet accord par un juge, ce qui lui donne la m\u00eame valeur qu\u2019un jugement.<\/span><\/p><p class=\"p1\"><span class=\"s1\">\u2022 <strong>Apr\u00e8s la signature de l\u2019accord<span class=\"Apple-converted-space\">\u00a0 <\/span><\/strong>\u2014 L\u2019accord \u00e9tant sign\u00e9, les engagements convenus dans l\u2019accord de m\u00e9diation doivent \u00eatre respect\u00e9s. <\/span><\/p><p class=\"p1\"><span class=\"s1\">Le nombre de s\u00e9ances d\u00e9pend d\u2019une situation \u00e0 l\u2019autre et ne peut se pr\u00e9voir \u00e0 l\u2019avance.
